Rileys Softwash LLC Terms and Conditions
Terms and Conditions Applicable to all Contracted Projects
1) Legally Binding Agreement: By entering a contract with Rileys Softwash LLC, you are entering a legally binding contract for work to be completed at an agreed upon price. In the event that you break this contract, all deposits made to the company shall be surrendered as damages.
2) Product Warranties: All warranties are limited to those offered by the manufacturers of the products used. Rileys Softwash LLC makes no additional warranties. If you ever have a concern regarding our work, Rileys Softwash LLC should be notified immediately.
3) Water Usage: By entering this agreement, you agree to provide Rileys Softwash LLC the right to use an on-site water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.
4) Electrical Usage: By entering this agreement, you agree to provide Rileys Softwash LLC the right to use an on-site source of electricity as needed to complete the stated project without compensation. If an exterior source is required, it will be at an additional charge.
5) Color and Tone Concerns: The properties and species of wood, age, and weather can greatly affect the resulting color or tone of the stain. Note: Variances may occur on individual boards as well as total project as densities and other characteristics vary across and throughout the wood. Rileys Softwash LLC and its associates attempt to represent final finish color and tones as best as possible. While we can often give you an idea of the overall color or tone you must expect some variance in the overall finish.
6) Courtesy: While Rileys Softwash LLC is on location and performing work on your property, you are responsible for keeping all children and pets, as well as other individuals away from the work area. Children and pets must be kept off work surface for at least 24 hours after our work is completed. This is for your safety as well as our own.
7) Payments: Payments to Rileys Softwash LLC are due as per the contract schedule and are to be paid by check, cash, or credit/debit card. All balances are due upon completion of the job. Any variance to this policy must be agreed upon and in writing or electronic means such as text or email. Late charges will be immediately assessed on all balances not paid in accordance with contract terms. The customer agrees to pay any collection cost incurred by Rileys Softwash LLC related to the collection process of outstanding balances.
8) Scheduling: Scheduling in a business in which productivity relies upon the weather can be difficult. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.
9) Removal & Replacement of Deck Contents: Removal and replacement of grills, deck furniture, planters and any other items are the responsibility of the homeowner. Should we need to remove items from the deck, we will not be responsible for any damage, breakage or for storage issues. We may wash around these items or reschedule service at the sole discretion of Rileys Softwash LLC.
10) Damages: Rileys Softwash LLC is not responsible for damages due to any defective or improperly installed siding, loose shingles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters and leaders and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the color or cause fading. The washing process, which entails removal of chalky, gritty, or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. Rileys Softwash LLC will not be responsible for such conditions. Rileys Softwash LLC will not be responsible for loose mortar that may dislodge during the cleaning process. Rileys Softwash LLC is not liable for any consequential or incidental damage or for any loss resulting from defects as noted in the agreement. Accordingly, you hereby hold Rileys Softwash LLC harmless for any damage to your structure, surfaces, or improvements thereon that result from the pressure washing process. Rileys Softwash LLC suggests the Client utilize their property’s breaker box to shut off power to all exterior outlets, light fixtures, or any other electrically powered features. This is especially important to outlets that are not covered with exterior covers. Rileys Softwash LLC will not be responsible for plants or trees that become shocked or damaged by chemicals needed to clean the surfaces of the property properly. The client is responsible for covering any plants or trees that are sensitive to chemicals and/or over watering. It is always recommended that plants, trees and grass be watered both before and after pressure washing services are performed. Stained wood doors and other features should be covered before service by the homeowner. At times, chemicals used in the cleaning process can damage stained doors and other stained features. Windows may become water spotted as a result of our services. Window cleaning is NOT included. Rileys Softwash LLC does not guarantee the removal of hard water stains.
11) Stains: Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means and require a separate removal process.. We make every attempt to point these areas out to the customer when quoting the project. Sometimes these stains cannot be removed at all.
12) Water intrusion: Rileys Softwash LLC expects your property to be in good repair and weathertight. This includes but is not limited to all electrical service including receptacles and light fixtures. Doors and windows shall also be weathertight. Rileys Softwash LLC is not responsible for damages as a result of water infiltration due to poor or improper installation, maintenance, repair of electrical related items, or doors or windows not sealed properly.
13) Removal & Replacement of Signage: Customer shall remove or adequately protect all exterior signage or similar exterior objects that could be damaged due to exposure to high water pressure or chlorine-based chemicals/solutions. Additional labor charges may apply for the removal/protection/replacement of these items.
14) Safety: While Rileys Softwash LLC is on location and performing work and for a period of 24 hours after completion, you are responsible for keeping all children, pets and other vulnerable individuals away from the work area and off of the work surfaces. This is for their safety as well as our own.
15) Work stoppage: In the event that work must be stopped while job is in progress, due to changes by customer or unforeseen defects or delays on the customer’s part, the customer will pay for labor time incurred. If the situation can be remedied on the job by the contractor, he will do so with customer’s consent.
16) Labor: Rileys Softwash LLC guarantees that the labor supplied under this contract meets or exceeds the standards of the trade. If you ever have a concern regarding our methods or quality of work, Rileys Softwash LLC should be notified by phone within 48 hours of job completion. Rileys Softwash LLC shall only be obligated, under this warranty for structural or plant damages which are a direct result of operator error, and which are fully described in writing to Rileys Softwash LLC within 15 days of job completion by sending written notice to: Rileys Softwash LLC, 3022 Derr road, Springfield Ohio,45503 . Rileys Softwash LLC shall be allowed 30 days from receipt of any written notice to inspect and attempt to repair or resolve the issue. During that time, Rileys Softwash LLC shall have sole option of repairing (or contracting for the repair of any structural, aquatic or plant damages that are a direct result of Operator error. The maximum limit of liability of Rileys Softwash LLC under this warranty shall be total amount of money paid by the customer to Rileys Softwash LLC under terms and conditions of their contract.
The above warranties do not apply to any work or product not provided by Rileys Softwash LLC. Rileys Softwash LLC assumes no liability for cancellation or noncompletion of a job due to causes beyond its control such as due to acts of God, labor disputes or material shortages. No representation or warranty made by any other person, expressed, or implied, other than an authorized representative of Rileys Softwash LLC which is not specifically set forth herein shall be binding upon Rileys Softwash LLC.
